Cancellation Policy
1. Cancellations made 7 days or more before departure will receive a partial refund (excluding processing fees).
2. Cancellations made within 7 days of departure are non-refundable.
3. If The Cuban Experience LLC cancels a trip due to unforeseen circumstances (e.g., extreme weather, government restrictions), travelers will be offered a full refund or rescheduled trip
4. No refunds will be provided for missed departures, no-shows, or travelers who fail to meet entry requirements.
Refund Policy
Our Day Trip to Havana needs at least 4 paying passengers to embark. If the airline does not have the required minimum number of passengers, the flight will be canceled, and you will be given the option to reschedule your trip or receive a refund of the ticket price. You may reschedule your Day Trip to Havana for a future date within 12 months from your initial booking date. Cancelations due to weather, maintenance, or other unforeseen circumstances are at the sole discretion of the pilot & airline for your safety. If the operator cancels the flight, you will be given the option to reschedule your trip or receive a refund of the ticket price. You may reschedule your Havana Day Trip excursion for a future date within 12 months from your initial booking date.
Legal and Export Restrictions
1. Compliance with U.S. Regulations
The Cuban Experience LLC is fully committed to adhering to all U.S. laws and regulations governing travel to Cuba, including:

Office of Foreign Assets Control (OFAC): We operate under the “Support for the Cuban People” category (31 C.F.R. §â€¯515.574).

Export Administration Regulations (EAR): We also comply with applicable U.S. Department of Commerce regulations regarding the export of goods, technology, or software to Cuba.
2. Purpose of Travel & Prohibited Activities

Authorized Purpose: Travel services provided by The Cuban Experience LLC are strictly intended for “Support for the Cuban People,” which requires participants to maintain a full-time schedule of activities supporting independent local businesses, promoting interaction with Cuban civil society, or otherwise strengthening the local community.

No Pure Tourism: Purely tourist-oriented travel (such as beach vacations without a people-to-people or community-engagement component) is not allowed under U.S. regulations. By booking with us, you confirm that you are not traveling solely for tourism.
3. Record-Keeping Requirements

Traveler Obligations: Under OFAC regulations, each traveler must keep documentation (itineraries, receipts, lodging confirmations, etc.) that demonstrates compliance with the “Support for the Cuban People” category for at least five (5) years.

Company Retention: The Cuban Experience LLC also maintains internal records of itineraries and related documentation to verify compliance should OFAC request an audit.
4. Restricted Entities & Prohibited Transactions

Cuba Restricted List: The U.S. Department of State periodically updates its list of Cuban entities with which direct financial transactions are generally prohibited. The Cuban Experience LLC does not knowingly engage with these restricted entities.

Traveler Responsibility: It remains your responsibility to avoid unauthorized transactions with restricted entities. If a violation is discovered, The Cuban Experience LLC reserves the right to cancel your trip or remove you from the itinerary without refund.
5. Export & Import Controls

U.S. Export Controls: Travelers must ensure any items they bring to or from Cuba adhere to the Export Administration Regulations (EAR). Certain high-value items, commercial goods, or specialized technology may require an export license.

Cuban Import Restrictions: The Cuban government has its own regulations on imported goods. Travelers should review Cuban customs guidelines to confirm what is permitted.
6. Traveler Certification
By booking with The Cuban Experience LLC, you certify that:

You are traveling under the “Support for the Cuban People” category and will adhere to the associated full-time schedule of qualifying activities.

You will maintain all required records of your travel (receipts, itineraries, etc.) for at least five (5) years.

You will not participate in purely tourist activities or conduct unauthorized transactions with prohibited entities.
